How to File a Sunshine Law Request

Any Missouri citizen can request public records from any governmental body in the state. Here's how to do it effectively.

Key Deadlines: Under RSMo 610.023, public bodies must respond to Sunshine Law requests within three business days. If records cannot be provided within that time, the agency must acknowledge receipt and provide a timeline. Fees must be reasonable and disclosed in advance.

    Identify the Custodian of Records

    Determine which specific governmental body holds the records you're requesting. Each public body has a designated custodian of records — this may be a city clerk, county clerk, school district administrative assistant, or agency director. Look for the contact information on the agency's website or call their main office. For state agencies, the Missouri Secretary of State's office maintains a directory.

    💡 Tip: Send your request to the most specific office possible. A request to a county commission should go to the County Clerk's office, not a general county email address.

    Write Your Request

    Be specific about what records you want. Include date ranges, document types, and relevant names or topics. You do not need to explain why you want the records. Do not ask vague questions like "all documents about the budget" — instead, ask for specific records such as "all line-item budget documents for fiscal year 2025 approved by the City Council." The more specific your request, the faster and more complete the response.

    Your request should cite the Missouri Sunshine Law (RSMo Chapter 610) to put the agency on notice of your statutory rights. Use the sample template below as a starting point.

    💡 Tip: Keep your request narrow. Multiple focused requests are easier to track than one broad request that can be partially denied.

    Submit Via Certified Mail or Email

    Send your request by certified mail with return receipt, or by email with a read receipt. This creates a documented record of the date received, which starts the three-business-day clock. Keep your original request, the delivery confirmation, and all communications. If submitting by email, use a clear subject line such as "Missouri Sunshine Law Records Request – [Your Name] – [Date]."

    💡 Tip: Certified mail costs a few dollars and creates legally defensible proof of delivery. Worth it for any significant request.

    Track Response Deadlines

    The agency must respond within three business days. Mark your calendar. A response can be (a) the records, (b) a fee estimate and timeline for producing the records, or (c) a denial stating the specific statutory exemption relied upon. If you receive no response within three business days, you have the right to treat this as a denial and pursue remedies including a complaint to the Missouri Attorney General or filing in circuit court.

    Agencies may charge reasonable fees for copying and staff time spent searching records. They must provide a written fee estimate before producing records if costs will exceed $10. You may challenge fees you believe are excessive.

    Appeal if Denied

    If your request is denied, the agency must cite a specific exemption under RSMo 610.021. Review the cited exemption carefully — many agencies improperly assert broad exemptions that do not actually apply. You can challenge a wrongful denial by:

    • Sending a written challenge letter citing the specific reason the exemption does not apply
    • Filing a complaint with the Missouri Attorney General's Office (no filing fee required)
    • Filing a petition in the circuit court of the county where the public body is located

    Courts may award attorney's fees to successful plaintiffs in Sunshine Law cases, which deters agencies from making baseless denials.

Missouri Transparency Laws

Key statutes governing public access to government records, open meetings, financial disclosure, and ethics in Missouri.

Missouri Sunshine Law — Open Records

RSMo Chapter 610 (§§ 610.010 – 610.035)

Missouri's primary open records and open meetings law. Any person may request public records from any public governmental body in the state. The law presumes all governmental records are open unless a specific enumerated exemption applies. Exemptions are to be narrowly construed in favor of disclosure.

  • Response required within 3 business days
  • Denials must cite specific statutory exemption under RSMo 610.021
  • Unreasonable fees or delays can be challenged in circuit court
  • Courts may award attorney's fees to prevailing requesters
  • Willful violation is a Class B misdemeanor; knowing violation is a Class A misdemeanor

Open Meetings Requirements

RSMo 610.010 – 610.035

All meetings of public governmental bodies must be open to the public. The government must post agendas at least 24 hours in advance (72 hours for emergency meetings). Meeting minutes must be taken and made available. Closed sessions are permitted only for specific purposes listed in RSMo 610.021 and must be formally voted upon.

  • 24-hour advance notice required for regular meetings
  • Vote to go into closed session must be taken in open session
  • The purpose of any closed session must be specifically stated
  • Votes taken in closed session must be made public if related to personnel decisions or final action
  • Citizens have the right to record meetings (audio/video) without agency permission

Financial Disclosure Requirements

RSMo 105.483 – 105.492

Elected and appointed officials of public governmental bodies — including special districts, school boards, and county commissions — must file annual financial interest statements with the Missouri Ethics Commission. These statements disclose business interests, ownership in companies, sources of income over $2,500, and other financial relationships that could affect official duties.

  • Annual filing deadline: May 1 for the preceding year
  • Applies to officials earning $15,000+ annually in their governmental position, and to all appointed board members of governmental bodies
  • Failure to file is a Class A misdemeanor
  • False statements on disclosure forms are a Class D felony
  • Filings are public records available through the Missouri Ethics Commission

Ethics Commission Rules — Conflicts of Interest

RSMo 105.450 – 105.470

Missouri law prohibits public officials from participating in governmental decisions in which they have a personal financial interest. Officials must recuse themselves from votes and discussions where such conflicts exist and must not use their public position to financially benefit themselves, family members, or businesses in which they hold interests.

  • Direct and indirect financial interests both require recusal
  • Family member interests (spouse, dependent children) are attributed to the official
  • Missouri Ethics Commission investigates complaints and may refer cases for prosecution
  • Violations may result in civil penalties up to $1,000 per violation and removal from office
  • Criminal referrals are possible for willful violations

Governmental Bodies — Definition and Coverage

The Sunshine Law broadly covers any agency, department, bureau, division, board, commission, authority, district, or committee of the state or of any political subdivision of the state. This includes — but is not limited to — cities, counties, school districts, special taxing districts, port authorities, fire protection districts, water districts, and quasi-governmental entities that perform public functions with public funds.

  • Courts broadly construe "public governmental body" in favor of coverage
  • Private entities receiving public funds may be subject to Sunshine Law for those records
  • Advisory bodies and task forces established by governmental bodies are typically covered
